CCAC unveils case of suspected passive bribery and leakage of confidential police data by a police officer

Some time ago the CCAC received intelligence that a police officer of the Public Security Police Force had allegedly committed crimes including passive bribery and leakage of confidential police data. Following an investigation, the CCAC found that the police officer, who used to station at the Outer Harbour Ferry Terminal, had received illicit advantage in return for his fabrication of an illegal immigrant’s entry records and assistance to the person in departure through the border checkpoint he stationed at. The investigation revealed that the police officer had also been allegedly leaking certain people’s travel records to a person who was active in casinos in return for monthly reward “per capita”. The duo were suspected of having committed passive bribery to perform illicit acts and active bribery respectively under the Penal Code. In addition, the police officer was also suspected of sheltering and computer falsification.

The CCAC also found that the assets owned by the police officer were far more valuable than the total income earned from his public position over the years, which included assets worth more than MOP5,000,000 from unexplained source, which were not truly declared in the declaration of assets and interests he had submitted. His acts were suspected to have constituted unexplained wealth and inaccurate data prescribed in the Legal Regime of Declaration of Assets and Interests.

Meanwhile, it came to light following the investigation that the police officer, upon someone’s request, checked confidential police data including other people’s travel records, surveillance data and the data about cases under investigation through four co-workers who worked in different departments. Then he leaked the information to others. The police officers secretly checked and leaked the said confidential data without the superior’s authorisation. Their acts were suspected to have constituted power abuse, breach of secrecy and breach of judicial secrecy under the Penal Code.

The case has been referred to the Public Prosecutions Office upon completion of the investigation. Following the suggestion of the Public Prosecutions Office, the judge of the Criminal Investigation Court has ordered to impose coercive measures including regular report on the aforesaid police officers.
